There are three steps to follow for submitting a self-declaration for ITS content and/or services in accordance with the Delegated Regulation (EU) No 886/2013:
Step 1: Identification of relevant data and/or services
Prior to submitting a self-declaration, please get in touch with the ITS contact point whether possible ITS data and/or services are covered by the provisions of the Delegated Regulation (EU) No 886/2013.
Step 2: Fill in the self-declaration form (one per service and data set)
Please refer to the download area or the infobox to obtain the self-declaration form. You need to fill in a separate form for each service your company provides and each data set your company holds.
The form must be filled in completely and truthfully and must be signed by an authorised signatory.
Step 3: Submit the filled-in self-declaration

In accordance with Article 9, Paragraph 2, of the Delegated Regulation (EU) No 886/2013, public and private road operators, service providers and broadcasters dedicated to traffic information shall provide the designated national bodies with their identification details and a description of the information service they provide, and submit a declaration of compliance with the requirements set out in Articles 3 to 8 of this regulation.
The declaration shall contain the following elements, where applicable:
a) the road safety-related categories covered and the road network coverage of the information service;
b) information on their access point to road safety-related traffic data and its conditions of use;
c) the format of the road safety-related traffic data accessible through their access point;
d) the means of dissemination of the information service to end users.
A “service for providing road safety related minimum universal traffic information to users” means a real-time traffic information service which provides all extracted, aggregated and processed safety-related road traffic information that are made available to end users by public and/or private road operators and/or service providers via any channel. The obligation depends on whether a service provider has undertaken to process the safety-relevant information and make them available for other users. The mere availability of raw data is not sufficient.
Intelligent Transport Systems (ITS) are defined as systems in which information and communication technologies are applied in the field of road transport, including infrastructure, vehicles and users, and in traffic management and mobility management, as well as for interfaces with other modes of transport (§ 2 Z 1 IVS-G). An ITS service means the provision of an ITS application through a well-defined organisational and operational framework with the aim of contributing to user safety, efficiency, comfort and/or to facilitate or support transport and travel operations (§ 2 Z 4 IVS-G). An ITS service provider is any provider of an ITS service, whether public or private, who consequently has to submit a self-declaration.
The events or conditions covered by the road safety-related minimum universal traffic information service shall consist of at least one of the following categories:
(a) temporary slippery road;
(b) animal, people, obstacles, debris on the road;
(c) unprotected accident area; short-term road works;
(d) reduced visibility;
(e) wrong-way driver;
(f) unmanaged blockage of a road;
(g) exceptional weather conditions.
